Loyalitätserklärung Appointment: 10 Things to Know Before You Go

In short: You cannot fail the Loyalitätserklärung on vocabulary. It is a signed declaration plus, at many naturalisation offices, a ten-minute German conversation checking that you understood what you signed. Tick box 3.1, bring blue or black pen, be able to say what the two documents are, and have five principles of the freiheitliche demokratische Grundordnung ready. That covers most of it.

Your appointment is in a few days. You have a stack of German paperwork on the table, a vague sense that someone is going to ask you about the constitution, and no idea how much you actually need to know.

Here is the honest answer: far less than you fear, but not nothing.

1. You cannot fail it on memory

This is not the Einbürgerungstest. There is no pass mark, no multiple choice, no score. The caseworker is checking one thing: that you understood the document you signed and that you mean it.

Forgetting an article number does not sink you. Refusing the commitment, contradicting your own signed declaration, or saying something incompatible with equal rights and human dignity does. Those are very different failure modes, and only the second one is realistic for most applicants.

2. Know what the two documents are

You are signing two things, and a surprising number of people cannot name them when asked:

  • The Bekenntnis — a positive avowal that you commit to the free democratic basic order of the Grundgesetz.
  • The Loyalitätserklärung — a negative declaration that you do not pursue or support extremist activity, and never have.

A third document, the Merkblatt, is just the information sheet explaining both. The legal basis for all of it is § 10 Abs. 1 Satz 1 Nr. 1 StAG.

3. Tick exactly one box — almost certainly 3.1

The form offers three options. Box 3.1 says you have never pursued or supported extremist activity. That is the box for the overwhelming majority of applicants.

Box 3.2 is for people who once did and have since turned away, and it demands dates and evidence. Box 3.3 is for genuine uncertainty. If either applies to you, talk to an immigration lawyer before you sign anything — do not guess.

4. Be ready for “do you know what you are signing?”

This is the single most commonly reported question, and the one people fumble most. Prepare one sentence:

„Ja. Ich unterschreibe das Bekenntnis zur freiheitlichen demokratischen Grundordnung und die Loyalitätserklärung. Damit erkläre ich, dass ich die Werte des Grundgesetzes anerkenne und keine extremistischen Bestrebungen verfolge oder unterstütze.”

Yes. I am signing the commitment to the free democratic basic order and the loyalty declaration. With it I declare that I recognise the values of the Basic Law and neither pursue nor support extremist activity.

5. Have five principles ready, not nine

Nobody expects you to recite all nine principles of the freiheitliche demokratische Grundordnung. Five is plenty, and counting them off out loud buys you thinking time:

„Erstens die Volkssouveränität — alle Staatsgewalt geht vom Volke aus. Zweitens die Gewaltenteilung. Drittens die Bindung aller staatlichen Gewalt an Recht und Gesetz. Viertens die Unabhängigkeit der Gerichte. Und fünftens die Garantie der Menschenwürde.”

6. Know the three branches in one line each

Legislative — parliament, makes the laws. Exekutive — government and administration, carries them out. Judikative — the independent courts, apply them.

Why it matters, in one sentence: „So bekommt keine Institution zu viel Macht.” That no single institution gets too much power.

7. Prepare the history block — it is the one people skip

Since the June 2024 reform, the commitment explicitly covers Germany’s historical responsibility for National Socialist crimes, the protection of Jewish life, and Israel’s right to exist. Caseworkers have been told to check it, and it is the part applicants most often under-prepare.

One answer covers most of it:

„Die Verbrechen des Nationalsozialismus sind von Deutschland ausgegangen. Daraus ergibt sich bis heute eine besondere Verantwortung: jüdisches Leben zu schützen und für das Existenzrecht Israels einzutreten.”

One distinction worth having clear: factual criticism of any government’s policies is protected by freedom of expression. What is incompatible with the commitment is denying a state’s right to exist or holding Jewish people collectively responsible for Israeli policy.

8. Three words that trip up fluent speakers

  • Gewalt means power here, not violence. Staatsgewalt is state authority; Gewaltenteilung is the division of powers.
  • Verfolgen means to pursue, not to persecute. The form asks whether you pursued extremist aims.
  • Unmittelbar, as an election principle, means direct — no electoral college — not “immediate” in time.

9. Blue or black pen, and do not pre-sign

German authorities expect blue or black ballpoint. Never pencil, never red or green — those are reserved for official annotations, and no correction fluid.

Fill in your name and date at home, but leave the signature until you are at the counter. The form has a box where the caseworker records whether you signed in their presence, and some offices want to watch you do it.

10. Practise the one sentence you must say word for word

Before your certificate is handed over, you speak the feierliches Bekenntnis aloud:

„Ich erkläre feierlich, dass ich das Grundgesetz und die Gesetze der Bundesrepublik Deutschland achten und alles unterlassen werde, was ihr schaden könnte.”

Say it twice tonight. It is the last sentence you speak as a non-citizen.

What the appointment actually feels like

Ten to twenty minutes, at a counter or in a small office, usually one caseworker. Administrative rather than adversarial — a civil servant working through a checklist, not a cross-examination. In German throughout, but you already cleared B1, so the bar is comprehension rather than eloquence.

If you stumble, nothing happens. „Könnten Sie die Frage bitte wiederholen?” costs you nothing and is completely normal.

Quick answers

Is there always an interview for the Loyalitätserklärung?

No. It depends on your naturalisation authority. Some offices simply collect the signed form; others hold a Bekenntnis- und Loyalitätsgespräch of roughly ten to twenty minutes. Prepare as though there will be one.

How long should I spend preparing?

A focused hour covers this checklist. If your appointment is further out, a few short sessions across a week is comfortable — read your own Merkblatt first, then practise the answers out loud rather than only reading them.

Is the Loyalitätserklärung the same as the Einbürgerungstest?

No. The Einbürgerungstest is a written multiple-choice exam of 33 questions taken earlier in the process. The Loyalitätserklärung is a signed declaration, sometimes accompanied by a short conversation, and it has no score.

What if I genuinely do not know an answer?

Say so and explain the underlying idea instead: „Da bin ich mir nicht ganz sicher, aber ich würde sagen …” Caseworkers prefer an honest explanation to a recited paragraph — a memorised answer is what the law calls a Lippenbekenntnis, and that is precisely what the conversation exists to detect.
